Three actions in the St. Louis County District Court, all arising out of a collision between an auto driven by Richard Carmody, in which his wife, Lila Carmody, was a passenger, and an auto driven by Herbert Aho, in which his wife, Esther Aho, was a passenger. In an action against Esther Aho, special administratrix of the estate of Herbert Aho, Richard Carmody sought to recover for personal injuries, property damage, and consequential damage resulting from his wifes injuries, and, as guardian ad litem for his wife, for her personal injuries. In actions against Richard Carmody, Esther Aho sought to recover for her personal injuries and, as trustee of the next of kin, for the wrongful death of Herbert Aho. The cases were tried together before J. K. Underhill, Judge, and a jury, which returned a verdict for Lila Carmody for $25,731.98; for Esther Aho for $45,908.33; and for the defendant in the other action. Richard Carmody appealed from orders denying his motions for a new trial (No. 37,053) in the action brought by him individually and (No. 37,054) in the action brought against him by Esther Aho. Esther Aho appealed (No. 37,050) from an order denying her alternative motion for judgment notwithstanding the verdict or for a new trial in the action brought on behalf of Lila Carmody, the verdict having been reduced to $20,000. She also appealed (No. 37,051) from an order denying her motion for a new trial in the wrongful death action.
